The petitioner seeks bail in a case registered for offences punishable under Sections 302 and 201/34 of the Indian Penal Code.
It is submitted on behalf of the petitioner that the informant is the wife of the deceased and she is not an eye witness to the occurrence. There is no direct or indirect evidence against the petitioner in the occurrence and only on the basis of suspicion he has been implicated. It is contended that one of the co-accused, namely, Sarovar Thakur has already been granted bail by a coordinate Bench of this Court vide order dated 24.9.2015 passed in Cr. Misc. No. 27318/2015.
Patna High Court Cr.Misc. No.34695 of 2015 (3) dt.16-10-2015 2/2 Having regards to the facts and circumstances of the case, the petitioner, namely, Tufani Thakur is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Ballia P.S. Case No. 245/2014.
