1. Heard Mr. Shiv Prasad Gupta, learned counsel for the petitioner and Mrs. Nirmala Kumari, learned APP for the State.

2. This application has been filed for modification of the order dated 01.11.2023 passed by this court in Cr. Misc. No. 69133/ 2023 for extension of period of surrender of the petitioner before the court below.

3. Learned counsel for the petitioner submits that earlier petitioner was granted anticipatory bail by order dated 01.11.2023 passed in Cr. Misc. No. 69133/ 2023, whereby petitioner was directed to surrender before the court below within a period of six weeks from the date of the order, but the petitioner could not surrender within time due to serious illness

Patna High Court CR. MISC. No.43091 of 2024(2) dt.19-07-2024 2/2 of his father and he was in Delhi for treatment of his father.

4. In view of the aforesaid facts, two weeks further time from the date of receipt of this order is allowed to the petitioner to surrender in the court below.

5. This modification application is, accordingly, allowed.
