Heard the learned counsel for the petitioners as well as the learned counsel for opposite party no. 2. The petitioners apprehend their arrest in connection with Papariya P.S. Case No. 51 of 2021 registered for offence punishable under sections 353/34 of the Indian Penal Code. As per FIR, due to storm, electric supply was interrupted. The allegation against the petitioner is that when the officials of the electricity department were restoring the electric supply, the petitioners created hindrance in it.

No.45490 of 2021(3) dt.08-08-2022 2/2 The learned counsel for the petitioners has submitted that as a matter of fact, the electric wire fell on the cattle of the petitioners and some cattles died due to electric current. He has submitted further that the petitioners are the persons of clean antecedents and the electric supply was restored soon thereafter. Considering the above-mentioned facts and circumstances, the petitioners above-named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Papariya P.S. Case No. 51 of 2021, subject to condition as laid down under section 438(2) Cr.

P.C. At the time of surrender, the petitioners shall furnish an affidavit that they shall not engage in such kind of offence in future. Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
