The petitioner has preferred this application for grant of regular bail in connection with Agamkuan PS Case No 1272 of 2021 dated 28.12.2021 registered for the offence punishable under Sections 341, 323, 342, 324, 307, 302, 386/34 of the IPC. As per the prosecution case, the petitioner and the other co-accused persons assaulted the informant and his Mama resulting in the death of the informant's Mama. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner bears 14 criminal antecedents, as stated in paragraph 3 of the bail petition which are not related to the
Patna High Court CR. MISC. No.35667 of 2023(2) dt.24-07-2023 2/2 offence of murder. It is further submitted that there is general and omnibus allegation against the petitioner who is in custody in this case since 02.04.2023.
Learned APP has vehemently opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case, the period of custody as well as the nature of allegation against the petitioner, the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of ACJM IV, Patna City in Agamkuan PS Case No 1272 of 2021 dated 28.12.2021.
This application stands allowed.
