In such view of the matter, this writ petitioner is dismissed as having become infructuous. However, the
Patna High Court CWJC No.12116 of 2016 (3) dt.26-04-2017 petitioner is at liberty to participate in the new tender and the respondent authority shall consider his case on merit without being influenced by this order.
