JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-09-2015 Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. Petitioner being husband of the complainant is languishing in jail custody in a case in which, cognizance has been taken for the offence punishable under Sections498(A)/34 of the Indian Penal Code and Section-4 of Dowry Prohibition Act.

The contention on behalf of the petitioner is that the complainant was residing at her parental home and during pendency of this petition; she died at her father's home.

Considering the facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.36058 of 2015 (2) dt.01-09-2015 2/2 Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Complaint Case No. 1657 of 2011 to the satisfaction of learned Sub Divisional Judicial Magistrate, Katihar.
