The petitioner has preferred this application for grant of regular bail in a case registered under sections 420, 406, 409, 466, 467, 468, and 120B of the Indian Penal Code. As per the prosecution case, it is stated that the informant was cheated of a total sum of Rs. 5 lacs by the customer service point of the State Bank of India being run by Krishna Mohan, Mohan Giri as also other accused persons including the petitioner herein.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No specific allegations has been made against him. He was working merely as a peon and had nothing to do with the transaction with the customers. The main allegation is against Krishna Mohan

Patna High Court CR. MISC. No.45858 of 2021(4) dt.07-03-2022 2/2 and Mohan Giri. The petitioner is in custody since 7.1.2021 and investigation in the case is complete.

The application for bail is opposed by learned APP for the State who referring to the order of the learned court below submits that the petitioner was cashier in the customer service point. It is further submitted that the petitioner has antecedents of similar nature against him.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for over 1 year and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Nokha P.S. Case no. 25 of 2016 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate V, Sasaram (Rohtas).
