Petitioner seeks regular bail in a case registered for the offence punishable under Section 302, 120B of the Indian Penal Code and u/s 27.

As per the prosecution case, one Munna Pandey and two other unknown persons shot dead son of informant in the medical shop. It is further alleged that son of informant told him four days back that he has land dispute with Munna Pandey and he had given threat to give Rs. Five lakhs, otherwise he would be killed.

Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner

No.45205 of 2021(3) dt.04-01-2022 2/2 has come in this case during the course of investigation in the confessional statement of co-accused, Munna Pandey, who has already been granted bail by a co-ordinate Bench of this court vide order passed in Cr. Misc. No. 18809/ 2019. No incriminating article has been recovered from the possession of the petitioner. Petitioner is in custody since 22.03.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj PS case No. 288/2018.
