Learned counsel for the petitioner is permitted to remove the defect(s), as pointed out by the office, if any, within a period of four weeks from today.

Petitioner seeks bail who is in custody since 13.12.2021 in connection with Patliputra P.S. Case No. 591 of 2021, F.I.R. dated 15.11.2021 for the offences punishable under Section 395 of the Indian Penal Code.

According to prosecution case, the petitioner along with other accused persons have looted the bag containing Rs. 41 lakh and some cheques at the point of pistol from Sanjeev Kumar while he along with the informant and one Chandan Kumar were going to deposit the said amount in the bank. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. He further submits that the petitioner was arrested in Patliputra P.S.

Patna High Court CR. MISC. No.36053 of 2022(5) dt.29-04-2023 2/2 Case No. 625 of 2021 and on the basis of the confessional statement he has been acquitted in the present occurrence. He further submits on the basis of the confessional statement of the petitioner, the cash amount of Rs. 4,80,000/- was recovered from the house of Late Kalicharan.

The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that it has come during investigation that the petitioner was involved in the present occurrence on the basis of the self confessional statement of the petitioner and the looted amount of Rs. 4,80,000/- was also recovered from the house of the petitioner. He further submits that the petitioner carries 3 more cases other than the present one.

Considering the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail in connection with Patliputra P.S. Case No. 591 of 2021 pending in the court of learned Additional Chief Judicial Magistrate-X, Patna. Prayer is refused.
