The petitioner, Shiv Bhajan Singh @ Ram Bhajan Prasad Singh, seeks bail in a case under Section 420 and other sections of the Indian Penal Code, section 8/20 (a) (iii), 29 of NDPS Act and under section 25(1-b) a, 25(1-A) of the Arms Act. The police raided the house of Sonu Kumar, son of the petitioner, on confidential information that Sonu Kumar is involved in drug trafficking and huge quantity of Ganja and other articles are recovered from the room of Sonu Kumar. The petitioner was not apprehended on the spot.

It is submitted that petitioner is a school teacher and he is separate from his son and nothing has been recovered from the possession or conscious possession of the petitioner. Similarly

Patna High Court Cr.Misc. No.35163 of 2015 (2) dt.21-08-2015 2/2 situated co-accused Sudeshwar Singh @ Sudeshwar Kumar has already been enlarged on bail vide order passed in Cr. Misc. No. 21805 of 2015.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Saran at Chapra in Parsa P.S. Case No. 08 of 2015.
