The petitioner seeks bail in a case registered for the offence punishable under Sections 414 of the Indian Penal Code and Section 25 (1-b) A/26/35 of the Arms Act. One loaded country made pistol and one live cartridge is said to have been recovered from the possession of the petitioner.
It is submitted by the learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern with the seized article. He has been falsely implicated in this case at the instance of his enemy by planting the
Patna High Court CR. MISC. No.33540 of 2019(2) dt.21-05-2019 2/2 aforesaid recovery from his possession. Though one more criminal case has been lodged against this petitioner but he is on bail in said case. Petitioner has been languishing in judicial custody since 12.10.2018.
Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Vaishali at Hajipur, in connection with Hajipur Town P.S. Case No. 727 of 2018.
