Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Forbesganj P.S. Case No. 347 of 2022 lodged under Sections 363, 366A of the I.P.C.
As per the prosecution case, the informant has disclosed that his alleged minor daughter was kidnapped by named accused persons with a view to marry.
Learned counsel for the petitioner submits that the allegation of kidnapping is not correct. The alleged victim girl has solemnized marriage with the petitioner and the said marriage has solemnized with consent. He further submits that
Patna High Court CR. MISC. No.36245 of 2022(4) dt.01-11-2022 2/2 vide order dated 20.09.2022, Superintendent of Police Araria was directed to recover the alleged victim and to take her statement under Section 164 of Cr.P.C. which is on record by which it transpires that the alleged victim has solemnized marriage with the petitioner and presently she has pregnancy of about 7 months. Before the Magistrate she has disclosed her desire to live at her sasural. Learned counsel further submits that petitioner is a man of clean antecedent and is in custody since 21.04.2022.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Forbesganj P.S. Case No. 347 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
