The petitioner seeks bail in connection with Khagaria (Mufassil) P.S. Case No.186 of 2014 registered for the offences punishable under sections 25(1-B)(a), 26 and 35 of the Arms Act. The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 16.9.2014 passed in Cr.Misc. No.30622 of 2014 with observation that if the trial is not concluded within nine months from the date of receipt/production of a copy of the order, the petitioner would be at liberty to renew his prayer for bail.
It has been contended that till date only four out of six chargesheeted witnesses could be examined on behalf of the prosecution during trial.
Patna High Court Cr.Misc. No.37036 of 2015 (2) dt.12-08-2015 2/2 Regard being had to the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Mufassil) P.S. Case No. 186 of 2014.
