ANJANA MISHRA ORAL ORDER 4 04-11-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 364/365/120(B) of the Indian Penal Code.

Earlier vide order dated 04.12.2014 passed by this Court, the prayer for grant of bail of the petitioner was rejected and thus the petitioner has renewed his prayer of bail. Learned counsel for the petitioner submits that certain witnesses in the Court below have not stated anything against this petitioner.

A report was called for from the Court below and it appears from the report that three witnesses of the present case have already been examined and summons have been issued for

Patna High Court Cr.Misc. No.36469 of 2015 (4) dt.04-11-2015 P2/2 examining the rest of the witnesses.

It is thus, directed that Sessions Trial No. 96 of 2015 be concluded positively within a period of six months from the date of receipt/production of a copy of this order. The trial in the case must proceed on day-to-day basis and the petitioner shall not seek any unnecessary adjournment in the same.

It is made clear that if the trial is not concluded within the aforementioned period without any hindrance having been caused by this petitioner, the Court below shall consider the question of grant of bail of this petitioner by itself as the petitioner has already remained in custody for more than fifteen months. With the aforementioned directions, this application is disposed of.
