Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code as well as Section 27 of the Arms Act, registered in connection with Madhepura P.S.Case No.196 of 2021.

No.45218 of 2021(2) dt.12-04-2022 2/3 As per allegation, the accused persons including the petitioners attacked the house of the informant and petitioner no.1 fired shot, touching the head of the informant. The younger brother of the informant Chotu Kumar intervened on whom petitioner no.1 also fired, who sustained injury on his head. The allegation against petitioner nos.2 and 3 is of assaulting the informant and his brother by lathi etc.

The learned counsel for the petitioners has submitted that both the parties are agnates. There is case and counter case and the injury reports with respect to the injuries sustained by the informant and his brother have been annexed as Annexure-2 and 2/1, which are simple in nature, caused by hard and blunt object.

Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in in connection with Madhepura P.S.Case No. 196 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.
