JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 20.02.2015. The victim has already returned to her home. The statement of victim was recorded under section 164 of the Cr.P.C in which she has stated that she was allured by the petitioner and thereafter she was taken away by the petitioner and she was kept in his house. Learned counsel for the petitioner submits that the statement of victim reflects that she was in love with petitioner and moreover, the victim has no where stated about any misbehavior of petitioner with her.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,

Patna High Court Cr.Misc. No.35288 of 2015 (2) dt.26-08-2015 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in connection with Gopalpur P.S.Case No. 18 of 2015.
