JUSTICE AJAY KUMAR TRIPATHI ORAL ORDER 30-01-2015 As usual, the University has failed to file counter-affidavit within six weeks granted earlier, but taking into consideration the order issued by the State of Bihar, Department of Education Government of Bihar, dated 18-6-2014, contained in Annexure-A to the counter-affidavit of respondent nos. 1 to 4, the entitlement of the petitioner for the pay-scale of Rs.5500-9000/- with effect

Patna High Court CWJC No.6676 of 2014 (3) dt.30-01-2015 2 / 2 from 1-4-1997 cannot be disputed.

The grievance of the petitioner is that he has been paid salary at a lower pay-scale than the above pay-scale. If so, he will be entitled to the difference of salary arising due to lower payscale. The University is directed to ensure that the petitioner is paid difference of salary within a period of three months from the date of production of a copy of this order.

With the aforesaid direction this writ application is disposed of.
