1. Heard the parties.

2. The petitioner seeks regular bail in connection with Natwar P.S. Case No. 55 of 2024 dated 08.03.2024 registered under Sections 341, 323, 324, 307, 379, 504 of the I.P.C.

3. As per the prosecution case on 08.03.2024 while the sons of the informant namely, Sanjeet Kumar and Ranjeet Kumar were going to market, the petitioner along with his father Sahendra Singh assaulted the informant's sons by means of Garasa, Bhala, Danda etc.

4. Learned counsel for the petitioner submits that there is admitted land dispute between the parties which would be evident from the F.I.R. itself. There is case and counter case inasmuch as Natwar P.S. Case No. 56 of 2024 has been lodged by the petitioner against the informant, his sons and others. The father of the petitioner sustained grievous injuries on his nose

Patna High Court CR. MISC. No.39898 of 2024(3) dt.26-07-2024 2/2 due to the assault made to his father and mother by the informant's sons. He next submits that the petitioner is in custody since 09.03.2024 and both the parties have filed compromise petition before the concerned court. He further submits that the father of the petitioner namely, Sahendra Singh has been extended the privilege of anticipatory bail by this Court in Cr. Misc. No. 38392 of 2024.

Regard being had to the submissions made by the parties, taking into consideration the fact that there is case and counter case between the parties, there is admitted land dispute between them, the petitioner is in custody since 09.03.2024 and the co-accused has been extended the privilege of anticipatory bail, as such, I am inclined to grant regular bail to the petitioner.

6. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10,000 /- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Bikramganj, Rohtas in connection with Natwar P.S. Case No. 55 of 2024.
