The petitioner is in custody in a case registered under Sections 25(1-b)a,26 of Arms Act.
The prosecution case in, brief, is that on information, the informant, Officer Incharge of Bachhwara Police Station, along with other police personnel stopped the bus and a search was made. It is further alleged that the petitioner was caught in that bus, who was having one pistol along with magazine loaded cartridge and one mobile.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 6.5.2015.Charge sheet has been submitted in this case. As per prosecution case, one country made
Patna High Court Cr.Misc. No.38016 of 2015 (3) dt.07-10-2015 2/2 pistol, magazine, live cartridge and one magazine are said to have been recovered from the possession of the petitioner. The petitioner has denied the said recovery.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in Bachchwara P.S.Case No. 84 of 2015.
