JUSTICE SATYAVRAT VERMA ORAL ORDER 05-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks regular bail in connection with Motipur P.S. Case No. 218 of 2020 instituted for the offences under Sections 395 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 26.11.2020 and charge-sheet has been submitted in the case.
Learned counsel for the petitioner submits that allegation is of looting Rs. 3,40,000/- from Hero motorcycle agency of the petitioner by five unknown criminals. Learned counsel for the petitioner submits that F.I.R. was against unknown and the petitioner was arrested in Motipur P.S. Case No. 219 of 2020 and based on his confessional
Patna High Court CR. MISC. No.45029 of 2021(2) dt.05-01-2022 2/3 statement in that case, he was remanded in the present case. Further it is submitted that petitioner has not been put on T.I.P. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner and submits that petitioner has got one criminal antecedent as mentioned in paragraph '3' of the bail application.
Considering the fact that the petitioner is in custody since 26.11.2020, charge-sheet has been submitted in the case, he has not been put on T.I.P. and was remanded from Motipur P.S. Case No. 219 of 2020 based on his own confessional Statement, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IInd (West) Muzaffarpur in connection with Motipur P.S. Case No. 218 of 2020 with a condition that one of the bailors shall be the father of the petitioner and the petitioner will keep marking his attendance in the concerned police station in between 25-30 of every month till framing of charge commencing from January, 2022, in the event it is reported by the concerned police station to the learned court below that the petitioner in between the aforesaid dates in any of the month has not marked his attendance before framing
