Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. Learned counsel for the petitioner points out that the present case was registered for the offence punishable under Sections-302, 307, 387/34 of the Indian Penal Code and 27 of the Arms Act but after due investigation, police submitted charge sheet for the offence punishable under Section-304 of the Indian Penal Code. It is further contended by him that petitioner voluntarily, surrendered before the court below on 13-05-2015 and since then, he has been languishing in jail custody.

Patna High Court Cr.Misc. No.36381 of 2015 (2) dt.31-08-2015 2/2 Considering the facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Malsalami P.S. Case No. 87 of 2013 to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City.
