Mr.Anil Kumar Singh No. 1 ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-08-2019 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks regular bail in connection with Barun P.S. Case No. 130 of 2018, registered for the offence punishable under Sections 392 of the Indian Penal Code and Section 27 of the Arms Act.
The allegation is regarding unknown accused persons having arrived at Lovely Indian Gramin Distribution Mustul, Barun where they are said to have threatened the customers and are said to have snatched a sum of Rs. 2.33 lakhs approximately, as also had engaged in firing from the pistol.
The learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.33448 of 2019(3) dt.17-08-2019 2/2 there is no prima facie evidence in the case diary so as to implicate the petitioner in the alleged crime. It is submitted that though reference has been made to the CCTV camera in the F.I.R., but during the course of the investigation, the police has not investigated on the said aspect, hence, there is no material at the moment so as to connect the petitioner with the alleged crime. It is further submitted that though there is one other case pending against the petitioner, but he is on bail in the said case. Lastly, it is submitted that the petitioner is languishing in custody since 1.3.2019.
Mr. Ashok Kumar, the learned APP for the State opposes the prayer for bail.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Barun P.S.
