2. The petitioner is apprehending his arrest in connection with Khagaul P.S. Case No. 74 of 2024 for the offence under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022.
3. As per the prosecution story, total 220 litres of illicit country made liquor was recovered from the Tempo.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has no concern with the alleged recovery. The petitioner is the onwer of the said seized vehicle
Patna High Court CR. MISC. No.38473 of 2024(3) dt.04-02-2025 2/2 but the same was not being driven by him at the time of the alleged recovery. No incriminating article has been recovered from the conscious possession of the petitioner. The petitioner has clean criminal antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.
6. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfactgion of learned Special Excise Judge, Danapur in connection with Khagaul P.S. Case No. 74 of 2024 subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
