Petitioner apprehends his arrest in Barun P.S. Case No.148 of 2018, registered under Sections 147, 148, 149, 341, 353, 307 and 504 of the Indian Penal Code and 27 of the Arms Act.
The informant, Mines Development Officer, Aurangabad, alleged that while the accused persons were loading sand on Hyva, the informant went there and asked them not to load the sand. The informant alleged that one person opened firing on her. The name of the person who made firing was Sunil Singh. Later on the accused persons fled away. Learned counsel for the petitioner submits that Sunil Singh who is said to have fired has already been enlarged on anticipatory bail vide order dated 19.12.2018, passed in Cr.
Patna High Court CR. MISC. No.33445 of 2019(2) dt.21-05-2019 2/2 Misc. No.69316 of 2018. Subhash Singh @ Subhash Kumar @ Nage has also been granted anticipatory bail. Petitioner is of course named in the FIR but no specific allegation is made against the petitioner.
Taking into consideration the facts that the person, who is said to have fired at the informant, has already been granted anticipatory bail, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in connection with Barun P.S. Case No.148 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
