Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Section 366(A)/34 of the Indian Penal Code, registered in connection with Punaura P.S.Case No. 04 of 2020.

The allegation against the petitioners is that they enticed away the minor daughter of the informant with an intent for marriage.

The learned counsel for the petitioners has submitted that the victim did not support the occurrence in her statement

No.45226 of 2021(2) dt.12-04-2022 2/2 under Section 164 of the Cr.P.C. rather she has stated that her father used to scold her for her studies and it was the reason that she went to the house of her maternal aunt (Mausi). He has submitted further that when the informant realized the fact, he filed a compromise petition.

Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Punaura P.S.Case No. 04 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
