JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. No doubt, petitioner is not named in the first information report and hot exchange of words had taken place between the petitioner and informant prior to the alleged occurrence and after that allegedly, petitioner along with others came at the place of occurrence and unknown person gave dagger blows to the informant but according to prosecution case itself, the petitioner assaulted the informant with fists and slaps. The informant sustained two grievous injuries on his person but petitioner is not author of said injuries. Petitioner is in jail custody since 13.06.2015.
Patna High Court Cr.Misc. No.36702 of 2015 (2) dt.31-08-2015 2/2 Considering the aforesaid facts and circumstances as well as nature of allegation leveled against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Motihari Town P.S.case No. 364 of 2015.
