The petitioner has renewed his prayer for bail in a case registered under sections 302 and 34 of the Indian Penal Code.

It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 10.5.2022 passed in Cr. Misc. no. 56987 of 2021 giving liberty to the petitioner to renew his prayer for bail on framing of charge. Referring to the order dated 30.5.2022 (Annexure-3) it is submitted that charge has been framed against the petitioner by the learned trial Court under section 302/34 of the Indian Penal Code. The petitioner is in custody since 2.3.2021 and undertakes to cooperate in the trial.

Having heard learned counsel for the parties and taking into consideration the liberty granted to the petitioner vide aforesaid order of rejection dated 10.5.2022, charge having been framed in the learned trial Court vide order dated 30.5.2022 and the petitioner having remained in custody for more than 1 year since 2.3.2021, the Court directs the petitioner to be enlarged on bail in connection with Dinara P.S. Case no. 37 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-III, Bikramganj, Rohtas.
