The petitioner seeks bail in a case under Section 363, 366A, 379, 302, 201/34 of the Indian Penal Code. The informant made allegation that Karu Sah, the petitioner, kidnapped her daughter. She further alleged that Raju Sah, Pandit Sah and Ravi Gupta had given threatening to kill her husband as her husband was not agreeable to the marriage of his daughter. Her husband was killed and his dead body was thrown on the railway track.

The victim appeared and disclosed that she went along with the petitioner out of her own free will and solemnized marriage. The victim is a major girl aged about 20 years. It is submitted that for the death of Rajnath Sah U. D. case was registered and the police found that Rajnath Sah died in

Patna High Court Cr.Misc. No.38051 of 2015 (2) dt.26-08-2015 2/2 accident but taking advantage of missing of her daughter, the informant lodged this case.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in Bihia P.S.
