JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-09-2019 The petitioner seeks bail in connection with Phulwari Sharif P.S. Case No. 358 of 2019 dated 06.04.2019 instituted for the offences under Sections 467, 468, 474, 420, 120(B) of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

It appears that a truck was found standing in the field of one Santosh Kumar and on search, huge quantity of liquor was recovered.

It has been submitted on behalf of the petitioner that he has been made accused in this case on suspicion that the consignment of liquor belongs to him

Patna High Court CR. MISC. No.33020 of 2019(5) dt.06-09-2019 2/2 and his associates.

The petitioner does not have any criminal antecedents and he is in custody since 08.04. 2019. Considering the period of custody and the nature of accusation against the petitioner, he is directed to be released on bail on his furnishing bail bonds of Rs. 20,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Phulwari Sharif P.S. Case No. 358 of 2019, Special Case No. 3671 of 2019.
