JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-12-2020 Heard Mr. Arun Kumar, learned Advocate for the petitioners and the learned APP for the State. The petitioners seek bail in connection with Sadar P.S. Case No. 270 of 2020, dated 21.05.2020, instituted for the offences under Sections 413, 414 and 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

From the possession of petitioner Nos. 1 and 2,

Patna High Court CR. MISC. No.33398 of 2020(2) dt.14-12-2020 2/2 8.280 litres of foreign liquor was recovered. From the possession of petitioner No. 3, there is recovery of 386.720 litres of foreign liquor.

Learned counsel for the petitioners has submitted that the aforesaid recovery has wrongly been foisted upon them.

The petitioners are in custody since 22.05.2020 and they claim to be persons of clean antecedents. Considering the period of custody of the petitioners above-named, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise Act), Muzaffarpur in connection with Sadar P.S. Case No. 270 of 2020.
