Petitioner apprehends his arrest in Mufassil P.S. Case No.380 of 2018, registered under Sections 341, 323, 332, 333, 385, 384, 379, 353, 283, 308 and 34 of the Indian Penal Code. A.S.I. of Mufassil P.S., Gaya got information that some villagers of village Malsah forcibly collecting donation. When the informant went there to verify the information, the informant came across with Md. Abid Khan who disclosed that while he was going behind the pick up van carrying two purchased cows, the villagers demanded contribution. When he was giving Rs.200/-, the villagers forcibly took out Rs.1500/- from his pocket and also abused and assaulted him with stick after taking Rs.1500/-. The Officer-in-Charge also came on the spot but the villagers started pelting stones. The informant alleged that one of the Constable

Learned counsel for the petitioner submits that the name of the petitioner figured at Serial No.7 in the FIR but no specific allegation is made. Petitioner never demanded any contribution from anyone. The Constable is not known to the petitioner. It is further submitted that similarly situated co-accused, namely, Budhlal Chaudhary, Shankar Chaudhary and others have been granted anticipatory bail.

Taking into consideration the facts and nature of allegations made against the petitioner and the fact that the name of the petitioner surfaced in the case on the disclosure made by a Constable, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya in connection with Mufassil P.S. Case No.380 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
