2. The petitioner is in custody in connection with Harsidhi P.S Case No. 14 of 2025 registered for the offences punishable under Sections 309(4) of the B.N.S.

3. As per prosecution case, four unknown person on the point of weapon snatched cash of Rs. 81,196/- from the informant.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that petitioner is neither arrested on the spot nor any incriminating article has been recovered. It is also submitted that petitioner is in judicial custody since 23.12.2025.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR and impugned order, it appears that petitioner is not arrested on the spot and no any incriminating articles has been recovered from the conscious possession of the petitioner. Name of the petitioner transpired in this case from the confessional statement of the co-accused.

7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Motihari, East Champaran in connection with Harsidhi P.S Case No. 14 of 2025.
