The petitioner has filed the instant application for anticipatory bail apprehending his arrest in connection with Complaint Case No. 163 (C) of 2010 registered for the offences under Sections 120(B), 406,420 and 468 of the Indian Penal Code.

The allegation in the FIR is that the informant paid a sum of Rs. 1.7 lacs to the accused persons on the assurance that they would provide him employment in the Secretariat at Patna. However, they provided him a fake appointment letter. It is alleged that he was cheated of his 1.7 lacs rupees. It is submitted by learned counsel for the petitioner that

Patna High Court CR. MISC. No.34894 of 2019(2) dt.29-05-2019 2/2 besides the allegations being false and concocted, one of the similarly situated accused has been granted bail by this Court vide order dated 15.05.2013 passed in Cr. Misc. No. 16802 of 2013.

Learned APP for the State opposes the application. Having heard the learned counsel for the petitioner and the learned APP for the State, in view of the nature of allegations in the FIR as also in view of the fact that similarly situated co-accused has been granted bail by above mentioned order, I am inclined to enlarge the petitioner on bail. Let the petitioner namely, Ajay Ram surrender in the Court below within six weeks from today. In case of his arrest or surrender, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs 10,000.- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Complaint Case No. 163 (C) of 2010 subject to the conditions as laid down in Section 438 (2) of Criminal Procedure Code.
