2. The petitioners are apprehending their arrest in Jandaha P.S. Case No. 309 of 2024 registered under Sections 191(2), 126(2), 115(2), 118(1), 109, 103, 329(3) and 352 of the BNS.
3. As per the prosecution case, petitioner no. 1 along with some co-accused persons have abused the informant's father. When informant along with his father went to the accused house, petitioners along with other co-accused persons have badly assaulted the informant and his father. When informant took his father to the hospital, they declared him dead.
4. Learned counsel for the petitioners has submitted that there is no allegation against the petitioners of assaulting the deceased
Patna High Court CR. MISC. No.34606 of 2025(4) dt.04-11-2025 2/2 (informant's father) rather allegation of assaulting the deceased is against co-accused Rohit Kumar who has inflicted iron blow on the head of the deceased. So far as petitioners are concerned, allegation against them are general and omnibus.
5. Learned APP for the State opposed the prayer for anticipatory bail of the petitioners.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 309 of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure./ 482(2) of the BNSS, 2023.
7. It is made clear that the petitioners shall appear in the court below on each and every date fixed in the case till framing of charge.
