====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-01-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Chainpur P.S. Case No. 112 of 2019, registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that Satendra Singh, brother of informant Rajendra Singh moved on 13.03.2019 at about 8.40 P.M. in the field for irrigation. In the next morning, informant came to know that his brother Sarendra Singh has been killed by unknown by causing gun shot injury. Thereafter, informant went at the field and found dead body of his brother Satendra Singh sustaining firearm injury at his chest and near ear. Learned counsel appearing for the petitioner submits that on the basis of fardbeyan of informant Rajendra Singh, Chainpur P.S. Case No. 112 of 2019 was instituted

Patna High Court CR. MISC. No.33061 of 2020(3) dt.22-01-2021 2/2 under Sections 302, 201/34 of the I.P.C. and Section 27 of the Arms Act on 14.03.2019. In course of investigation, the informant in his re-statement disclosed the name of petitioner along with Bihari Bind and Mahendra Ram raising suspicion regarding having hand in the occurrence. Further submission is that, earlier, the prayer for bail of the petitioner was refused on 03.03.2020 vide Criminal Miscellaneous No. 61754 of 2019 taking into consideration the criminal antecedent as detailed in paragraph-03 of the petition. Further submission is that similarly situated co-accused Bihari Bind, whose name has also been disclosed by the informant in his re-statement, has already allowed privilege of bail by this Court on 02.06.2020 passed in Criminal Miscellaneous No. 8853 of 2020.

The petitioner is in custody since 04.05.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-X, Kaimur at Bhabua in connection with Chainpur P.S. Case No. 112 of 2019.
