2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 498A, 304 (B) and 34 of the Indian Penal Code .
3 . It is a case of dowry death . As per F.I.R., the daughter of the informant was married with co-accused Pintu Kumar in the year 2019, according to Hindu rituals and out of their wedlock two children were born . After the marriage, when deceased went to her matrimonial house, she was subjected to torture and cruelty by these petitioners and other in-laws family members due to non-fulfillment of demand of dowry and lastly, due to non-fulfillment of demand of dowry all the accused
Patna High Court CR. MISC. No.38626 of 2024(5) dt.09-09-2024 2/2 persons killed the deceased.
4. Petitioner No. 1 is father-in-law and petitioner No. 2 of the deceased. They are simply victims of over implications. They are separate in mess and property. There is no specific allegation is alleged against them and they have no concern with the affairs of the couple. Thrust of accusation is against the husband of the deceased who is already in custody since 06.09.2024 . Petitioners claim clean antecedent. 5 . Learned counsel for the State opposes the bail petition .

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let these petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Bhojpur at Ara in connection with Charpokhari P . S. Case No . 205 of 2023 , subject to the conditions laid down under section 438 of the Code of Criminal Procedure .
