The petitioner seeks bail in a case registered for the offences punishable under sections 363, 366/34 of the Indian Penal Code.

The informant alleged that his driver, namely, the petitioner and others kidnapped his wife in the night of 09.04.2015 and also took away ornaments and other articles worth rupees fifty thousand.

The informant lodged the case after one week of the occurrence. The victim was recovered and she made her statement under section 164 Cr.P.C. and disclosed that her driver and one unknown person kidnapped her in the night. The victim is mother of five children. The story of kidnapping does not inspire

Patna High Court Cr.Misc. No.35486 of 2015 (2) dt.21-08-2015 confidence and the F.I.R. itself was lodged after one week of the occurrence.

Considering the facts aforesaid, let the petitioner above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-divisional Judicial Magistrate, Udakishunganj, District Madhepura in connection with Pureni P.S. Case No. 23 of 2015.
