1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in Complaint Case No.2193 of 2016 registered for the offences punishable under Sections 420, 467, 465, 468 and 471 of the Indian Penal Code.
3. The learned counsel appearing on behalf of the petitioner submits that petitioner has antecedent of one case. It is next submitted that petitioner superannuated from service on 29.02.2024 as Circle Officer. It is next submitted that the petitioner joined, the place of posting where the occurrence is alleged to have been committed, on 09.07.2015, when the order of mutation was passed on 27.05.2015 that amply demonstrates
Patna High Court CR. MISC. No.41115 of 2024(2) dt.02-07-2024 2/2 that the order of mutation with respect to the land was passed by predecessor of the petitioner. It is next submitted that petitioner, at the time when the alleged occurrence is said to have taken place, was not even posted as Circle Officer, Katihar.
4. Learned A.P.P. opposes the anticipatory bail application.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Neha Singh, the learned Judicial Magistrate, 1st Class, Katihar in connection with Complaint Case No.2193 of 2016, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
6. The application stands allowed.
