The petitioner seeks bail in a case registered under Sections 302, 201/34 of the Indian Penal Code. The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application. Thereafter second bail application of the petitioner was rejected vide Annexure 2 to the present application, where a direction was made to the trial court to conclude the trial within a period of six months from the date of receipt/production of the order. It has been submitted on behalf of the petitioner that the petitioner is in custody since 4.8.2015 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has

Patna High Court CR. MISC. No.33315 of 2019(3) dt.04-09-2019 2/2 remained in custody for four years. Neither there is any eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest the implication of the petitioner in the present case.

A report was called for from the court below. It has been reported that the case is still pending for trial. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. III, Madhepura in connection with S.T. No.128 of 2016 arising out of Uda Kishunganj P.S. case No.64 of 2015.
