The petitioners seek bail in anticipation of their arrest in connection with Dagarua P.S. Case No. 60 of 2020,

Patna High Court CR. MISC. No.33686 of 2020(2) dt.19-03-2021 2/3 dated 22.04.2020, instituted for the offences under Sections 341, 323, 307, 324, 379, 448, 504 and 506/34 of the Indian Penal Code.

It has been alleged in the F.I.R. that because of an occurrence committed by the petitioners earlier, a complaint case was lodged by the informant vide Complaint Case No. 928 of 2019. The petitioners are alleged to have come to the house of the informant again for pressurizing her to withdraw that case. On refusal of the informant to do so, she was abused, assaulted and her personal belongings are said to have taken away.

The learned counsel for the petitioners has submitted that in the case about which reference has been given in the F.I.R., viz., Complaint Case No. 928 of 2019, no cognizance has been taken as yet. Apart from this, it has been stated that the accusation is absolutely false and such case has been lodged in order to put pressure on the petitioners not to pursue their claim in the share of the property. The petitioners are agnates of the informant and the injuries suffered by the victims have been opined to be

Considering the nature of accusation, the background facts and taking into account that the petitioners are related to the informant and others and they do not have criminal antecedents, they, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Dagarua P.S. Case No. 60 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
