The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code. Petitioner is not in the First Information Report. Nothing has been recovered from the possession of the petitioner. Name of the petitioner figured in the case in the confessional statement of Sunil Kumar Rai. The Additional Sessions Judge, VIth, has stated in his order that in paragraph No. 26 of the case diary, the witnesses identified the petitioner and disclosed his name. It appears that Rajiv Rai in Paragraph No. 26 of the case diary that while he was returning from the station, he identified Sunil Kumar Rai @ Chunna Rai, Subhas Rai, who were pointing pistol at the victim. The petitioner was standing behind the place of occurrence. It appears from the order itself that Sunil Rai and
Patna High Court Cr.Misc. No.36457 of 2015 (2) dt.24-08-2015 P2/2 Subhas Rai has been enlarged on bail. The witness came at very later stage and disclosed the name of the petitioner. The case of the petitioner is on better footing than that of Sunil Rai and Subhas Rai who have already been enlarged on bail.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 49 of 2015.
