JUSTICE JYOTI SARAN ORAL JUDGMENT Date: 17-09-2016 The petitioners in this batch of writ petitions are licensed deed writers duly licensed under the Bihar Deed Writers Licensing Rules, 1996 (hereinafter referred to as „the Licensing Rules‟) framed under Section 69(1)(bb) of the Registration Act, 1908 (hereinafter referred to as „the Act‟) and the Bihar Registration Rules 2008 (hereinafter referred to as „the Registration Rules‟) framed thereunder. The grievance of all the petitioners is common and which is the reason for analogous hearing of the writ petitions which, with the consent of the parties, have been heard and are being disposed of at the stage of admission.
As I have observed above, the grievance of all the writ
petitioners is common and they are all aggrieved by an instruction issued by the Principal Secretary, Department of Registration, Excise and Prohibition, Government of Bihar, Patna bearing Memo No. 2867 dated 13.6.2016 impugned in the respective writ petitions whereby, a direction has been issued to the District Sub Registrars as well as the District Registrar to only except such of the deeds which are computer typed and the reason is three fold namely:- (a) The handwriting on the documents are found illegible and thus unreliable.
(b) The overwriting and cutting found on the documents appearing on the documents presented, do not carry a verification by the executants; and (c) There have been instances of interpolation in the area, boundary and valuation in the hand written documents after execution thereof which generates unwarranted litigation.
Since all the writ petitions question the very same instruction issued by he Principal Secretary bearing Memo No. 2867 dated 13.6.2016 hence for the sake of convenience this Court would be referring to the pleadings made in C.W.J.C.No.10973 of 2016 unless clarified with specific reference to the other writ petitions. In fact, it is
on this account that this Court vide order passed on 20.8.2016 directed that a counter affidavit filed in the said case would be treated as a response to the issue raised and consequently a response in all the writ petitions. Counter affidavit has been filed in C.W.J.C.No.10973 of 2016 and when parties have been heard with a view to final disposal. Mr. Chitrajan Sinha and Mr. Y.V. Giri learned Senior Counsel have appeared for the petitioners in this batch of writ petitions duly assisted by the Advocate on record namely Mr. Sanjeet Kumar and Mr. Ranjeet Kumar and learned advocates appearing in the other writ petitions. Mr.Pushkar Narain Shahi learned AAG-6 has led the arguments for the State duly assisted by Mr. Mrigendra Kumar A.C. to G.A.4, Mr. Manish Kumar A.C. to AAG-6 and Mr. Mahtab Alam A.C. to SC 20 and other State counsels appearing in the respective writ petitions.
The argument of Mr. Sinha stands noted in the order dated 20.8.2016 and Mr. Sinha, learned Senior counsel with reference to the provisions underlying Sections 68A and 68B of „the Act‟ alongside Rule 6 of „the Rules‟ and Rule 9(e) and (g) of the Licensing Rules as well as the definition of a document as found in Clause 4(17) of the Bihar and Orissa General Clauses Act submitted that the direction issued to the District Registrar/District Sub-Registrar to accept only such sale deeds which are computer typed, is an unreasonable restriction on the right vested in the deed writers to
prepare hand written documents. According to Mr. Sinha, „the Act‟, „the Rules‟ as well as „the Licensing Rules‟ put no such restriction on the deed writers that they are to prepare only computer typed sale deeds. Mr. Sinha has referred to the instructions framed by the Department and particular reference to instruction No.95(a)(c)(d), he submits that even when the position stands clarified by instruction No.95(a) which inter alia provides that the document has to be written in ink, lithographed or printed on paper, vellum or vegetable parchment and shall contain a blank space of not less than one side of a foolscap half sheet or shall be attached to a covering slip containing such space and even when safeguards are present at Clause (c) and (d) thereof in case of any illegibility in the documents or tampering therewith, yet an unnecessary, unwarranted and unreasonable restriction is being imposed by the Principal Secretary through the impugned directions.
It is the argument of Mr. Sinha that whereas the option itself is present in paragraph 95(a) of the instructions which is in tune with the statutory provisions, allowing the deed writers to either prepare the document handwritten in ink or by printed on paper, until such time that such instructions are appropriately modified in accordance with law, the directions impugned at Annexure-1 issued by the Principal Secretary as contained in his letter bearing Memo No. 2867 dated
13.6.2016 has an overriding effect on the instructions which bear a statutory character. Learned counsel has made reference to an interim order passed by this Court in a batch of writ petitions present at Annexure-6 to submit that it is the interim relief granted to the petitioners against cancellation of their respective licence which has annoyed the Principal Secretary and is actually the reason behind the impugned directions.
Mr. Giri, learned Senior Counsel while adopting the arguments advanced by Mr. Sinha, has questioned the jurisdiction of the Principal Secretary to issue such directions. According to Mr. Giri, the appropriate statutory authority vested with powers of issuing directions or framing any rule in this regard is the Inspector General of Registration and not the Principal Secretary even though he may be the departmental head but the action of the Principal Secretary impugned herein, is a usurpation of statutory jurisdiction by the Principal Secretary which lies with the Inspector General of Registration. Learned Senior Counsel for the purpose has referred to the „Licensing Rules, 1996‟ and submits that these rules have been framed in exercise of powers conferred under Section 69(1)(bb). It is the argument of Mr. Giri that while Section 69(1) vests exclusive jurisdiction in the Inspector General to make rules consistent with „the Act‟, Clause (bb) was incorporated vide Bihar Amendment Act, 1947
(Act 14 of 1947) and whereunder it is the Inspector General of Registration who has the jurisdiction to frame rules relating to grant of licence to document writers and apprentices to document writers, the suspension and cancellation of such licence, the terms and conditions under which such licenses can be granted and for all purposes connected with the writing of documents to be presented for registration. He submits that even if the Principal Secretary is an Officer of a higher jurisdiction yet he is a stranger to the statute which only recognizes the Inspector General of Registration as a rule making authority.
Learned counsel has next referred to the definition of a Licensing Authority found under Rule 2(g) of „the Licensing Rules‟ and as well as Rules 13,14 and 15 thereof to submit that it is the licensing authority alone who has a power of suspension or cancellation of licence of a document writer on grounds listed below Rule 13 and against whose order, an appeal lies before the Inspector General of Registration, who also has the powers of a Licensing Authority. Mr. Giri, next refers to Rule 9(1) of „the Licensing Rules‟ to submit that while Rule 9(e) and (g) give an option to the deed writer to either prepare a hand written document or to get it printed, Clause 9(h) thereof binds him to the direction issued by the Inspector General of Registration on the preparation and transcription of documents or copies for registration. Mr.
Rule 6 of „the Registration Rules‟ to submit that it has been framed in exercise of powers vested under Section 69(1) (a) and (aa) of „the Act‟ and that the right of the document writers stands recognized. The argument of Mr. Giri in sum and substance is that the directions impugned of the Principal Secretary, is an act wholly without jurisdiction. Learned counsel in support has referred to a decision of the Supreme Court reported in (2010) 11 SCC 557 (Manohar Lal Vs. Ugra Sen) and with particular reference to the opinion expressed in paragraphs 12 to 23, he submits that the principle is well settled and no authority higher in hierarchy or even an appellate or revision authority, can exercise the power of a statutory authority nor can he direct a statutory authority to act in a particular manner. The arguments advanced by learned Senior counsel has been adopted by counsel appearing for the rest of the writ petitioners.
The argument of Mr. Giri learned Senior Counsel and Mr. Sinha, learned Senior counsel appearing for the petitioners, has been contested by Mr. Shahi learned AAG 6 leading the arguments for the State and who with reference to the stand taken by the Department in paragraphs 11 and 14 of the counter affidavit submits that the directions have been issued merely to meet the challenge posed due to bad hand writing of a large number of deed writers which was either
illegible or difficult to decipher. According to Mr. Shahi learned Additional Advocate General, it was to resolve such problem and to effectuate paragraph 95 of the instructions, that the directions in question have been issued which in no manner curtails the deed writers jurisdiction nor causes any impediment in their function. He submits that the object behind the direction is very laudable and it is in order to make documents executed for registration clear and free from any confusion. It is the argument of Mr. Shahi that not only the general public rather even the adjudicatory bodies some times face problem in deciphering the hand written documents and it is thus with a pious object that the instructions have been issued which create no restraint on the deed writers in discharge of their duties. I have heard learned counsel for the parties and I have perused the records.
The challenge posed to the impugned directions issued by the Principal Secretary, Department of Registration, Excise and Prohibition primarily centers around the following aspects:- (a) Whether he has the jurisdiction to issue such directions; and (b) Whether „the Act‟, „the Registration Rules‟ or „the Licensing Rules‟ make any restriction in the preparation of documents.
The arguments advanced by learned Senior counsel to question the impugned directions of the Principal Secretary, Department of Registration, Excise and Prohibition bearing Memo No. 2867 dated 13.6.2016 is that, it does not only suffer from error of jurisdiction but is also unsustainable for being in the teeth of the statutory prescriptions.
Since the action impugned is being defended by resorting to the public purpose and the object sought to be achieved by the directions, I would first be dealing with this issue.
No doubt, the object is laudable and considering the instructions impunged, independent of the statutory prescription, it may not invite any intervention but the question is where „the Act‟ and „the Rules‟ framed thereunder exclusively vests the Inspector General with such power of framing rules and issuing directions, whether any authority, superior in hierarchy can exercise powers to issue such directions and/or whether any such direction issued would effectively not only amend the statutory prescriptions, rather would be in supersession thereof.
The Inspector General under Section 69(1) of „the Act‟ exercises general superintendence over all the registration officers in the territories under the State Government and is vested with powers to make rules consistent with „the Act‟ from time to time. As pointed
out by Mr. Giri, learned Senior Counsel, Clause (bb) incorporated under the Bihar Amendment (Act 14 of 1947) amongst others, enables the Inspector General of Registration to frame Rules for grant of licenses to document writers and apprentices to document writers, the suspension and cancellation of such licenses, the term and condition under which such licenses can be granted and generally for all other purposes connected with the writing of documents to be presented for registration.
It is in exercise of powers vested under Section 69(1)(bb) that the Bihar Deed Writers Licensing Rules, 1996 has been framed and while Rule 2(g) defines „the Licensing Authority‟ to mean the „Registrar‟ of a District and includes any other officer duly authorized in his behalf, Rule 3(a) discusses the qualifications prescribed for a deed writer and Rule 3(b) deals with the reasons for disqualification. Rule 3(a)(c) amongst others, requires a deed writer to be fit enough to take the profession of a document writer.
Rule 9(1) of „the Licensing Rules‟ deals with the conditions of licence of the documents writers and Rule 9(e) and (g) very specifically prescribes that a document writer should be able to write or cause to be written any document legibly and in accordance with the instructions issued by the Inspector General of Registration or the Licensing Authority from time to time.
in clean and unambiguous terms.
Rule 9(1)(h) binds the document writers to the instructions and directions issued by the Licensing Authority from the Inspector General of Registration regarding preparation and transcription of documents for registration issued from time to time. Rule (2) of „the Registration Rules‟ makes reference to Section 68(2)A which was incorporated under the Bihar Amendment Act, 1991 to recognize document writing by Advocate, Pleaders and Mukhtars in addition to the work done by the document writers, licensed for the purpose. The Rule also grants liberty to the parties to draw the documents themselves.
Last but not the least is the instruction present at paragraph 95 of the „Instructions and Orders‟ issued under „the Act‟ and „the Rules‟ from time to time and Clause (a), (c) and (d) thereof very clearly gives the documenet writer an option of preparation of a document written in ink or printed on paper. Amongst others, the only other requirement found relevant in this context is present in Clause (c), which mandates that the document is to be written legibly more particularly where it relates to names of the parties, the property in question, the consideration amount and the relief prayed. Clause 9(e) of paragraph 95 provides for the safeguard to be followed to prevent tampering in the relevant recitals of a document viz. the dates, the amount of
consideration, the rate of interest, the description of property etc. A plain reading of the statutory provisions clearly demonstrates that there is no restriction imposed under „the Act‟ and „the Rules‟ framed thereunder including „the Licensing Rules‟ that a deed writer is to prepare only computer printed documents or that hand written documents in ink are impermissible and would be rejected on presentation. On the contrary, the option is clearly available under „the Act‟ and „the Rules‟ framed thereunder that a deed writer can well draw a document either written in ink or printed which obviously would include a computerized printing.
As I have said earlier, the object sought to be achieved under the directions even though worth appreciation, it definitely has a restrictive effect on the deed writers‟ right to prepare a document either written in ink or by printing on paper. Law is well settled and where a statute gives the mode, manner and option in which an act is to be performed as well as the options therefor, it cannot be interfered with by executive instructions, howsoever laudable, the object may be.
There is no contest on the statutory provisions which confers a right in the deed writers to draw up a document either hand written, typed or computer printed and so long as such right of the deed writers continues to be protected under „the Act‟ and „the Rules‟
framed thereunder including „the licensing rules‟, it cannot be interfered with by an executive direction.
This brings this Court to the issue raised by Mr. Giri regarding absence of jurisdiction in the Principal Secretary to issue such directions.
I have already discussed, the statutory provisions underlying Section 69(1) which vests exclusive jurisdiction in the Inspector General to frame rules consistent with „the Act‟ and clause (bb) incorporated vide Bihar Act 14 of 1947 further empowers him to frame rules relating to grant of licence to the document writers, the suspension and cancellation of such license, the terms and conditions under which licenses can be granted and generally for all purposes connected with the writing of documents, to be presented for registration. „The Act‟ thus confers exclusive jurisdiction in the Inspector General of Registration to frame rules relating to the grant of licenses of document writers or suspension/cancellation thereof. While Rule 2(g) of the „Licensing Rules‟ framed under Section 69(1)(bb) of „the Act‟ defines Licensing Authority to mean the Registrar of a District and includes any other officer authorized in this behalf, any order passed by the Licensing Authority to cancel or suspend licence of a document writer or an apprentice for any of the
grounds stipulated under Rule 13, is appealable before the Inspector General of Registration under Rule 14 and who also is vested with powers of Licensing Authority under Rule 15. The provisions referred to above would confirm that it is the Inspector General, Registration alone who is vested with the jurisdiction to frame rules which is consistent with „the Act‟ and even if the Principal Secretary in the Department of Registration, Excise and Prohibition is an authority superior in hierarchy, that by itself would not confer him with any privileged jurisdiction to issue any direction bearing statutory character, muchless a direction which is inconsistent with „the Act‟. In this context, I am persuaded to reproduce paragraph 23 of the judgment relied upon by Mr.
Giri learned Senior counsel rendered in the case of Manohar Lal (supra):- "23. Therefore, the law on the question can be summarised to the effect that no higher authority in the hierarchy or an appellate or revisional authority can exercise the power of the statutory authority nor can the superior authority mortgage its wisdom and direct the statutory authority to act in a particular manner. If the appellate or revisional authority takes upon itself the task of the statutory authority and passes an order, it remains unenforceable for the reason that it cannot be termed to be an order passed under the Act."
order bearing Memo No. 2867 dated 13.6.2016 of the Principal Secretary, Department of Registration, Excise and Prohibition impugned at Annexure-1 to C.W.J.C.No.10973 of 2016 as well as in the other writ petitions forming the batch herein, is illegal, suffers from vice of excessive jurisdiction and is issued in violation of the statutory prescriptions.
In result, the order bearing memo no. 2867 dated 13.6.2016 passed by the Principal Secretary, Department of Registration, Excise and Prohibition is quashed and set aside. The writ petitions are allowed.
