2. Petitioner seeks regular bail in connection with Bithan P. S. Case No. 131 of 2021 in a case registered for the offence punishable under Sections 30(a), 41(i)(ii) of the Bihar Prohibition and Excise (Amendment) Act, 2016 and Sections 25(1-b), (a), 26, 35 of the Arms Act.
3. As per the prosecution case, 907.5 liters & 500 ml. of illicit foreign liquor and four live cartridges of 0.315 bore was recovered from the house of co-accused Niraj Kumar Mahto, who disclosed the name of this petitioner.
4. Learned counsel for the petitioner submits that he is innocent and has committed no offense. He has been falsely implicated in this case. No incriminating material has been

The name of the petitioner transpired in this case on the basis of confessional statement of co-accused Neeraj Kumar, who has been granted privilege of bail by this Court in Cr. Misc. No. 69460 of 2021 vide order dated 14.02.2022. Petitioner is in custody since 11.03.2025.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise-1st, Samastipur in connection with Bithan P. S. Case No. 131 of 2021.
