For the Petitioner :

Mr. Hari Kishore Thakur, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-07-2026 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant.
2. The petitioner seeks bail in a case registered for the offence punishable under Sections 103(1) and 3(5) of the B.N.S..
3. As per prosecution case, marriage of daughter of informant was solemnized with this petitioner on 10.06.2015 as per Hindu rites and rituals. It is alleged that after some years of marriage, all the F.I.R. named accused persons, including this petitioner, started committing torture and harassment with the victim and on 20.02.2025, all the accused persons, including this petitioner, killed the victim by strangulating her.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence.
Patna High Court CR. MISC. No.35740 of 2026(2) dt.03-07-2026 2/3 Informant is not an eye witness to the occurrence and petitioner has falsely been implicated in this case merely because he happens to be husband of the victim. As a matter of fact, the deceased committed suicide. Moreover, charge-sheet has already been submitted and petitioner, having no criminal antecedents, is in custody since 11.04.2025.
5. On the other hand, learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner and submitted that petitioner is named in the F.I.R. and there is specific accusation that he, along with other co-accused persons, committed torture and harassment with daughter of informant and subsequently, committed her murder by strangulating her. Petitioner is husband of the deceased who died unnatural death at her matrimonial house.
6. Considering the facts and circumstances of the case, specific and direct nature of accusation and fact that petitioner is husband of the deceased who died unnatural death at her matrimonial house, the prayer for grant of bail to the petitioner is rejected.
7. However, considering the fact that petitioner is in custody since 11.04.2025, the learned trial court is directed to expedite the trial and conclude the same, preferably within a period of one year from the date of receipt/production of a copy
