2.Heard learned counsel for the petitioner and learned APP for the State.
3. The petitioner who apprehends arrest in connection with Amarpur P.S. Case no- 27 of 2026 lodged on 14.01.2026, for the offences punishable under sections 126(2), 115(2), 109(1), 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.
4. As per the prosecution, the F.I.R. has been lodged against two named accused persons alleging therein that both assaulted the informant by iron rod, lathi and danda due to which the informant got brutally injured.
5. Learned counsel for the petitioner submits that the informant and petitioner are gotiya and a long standing land
Patna High Court CR. MISC. No.36020 of 2026(2) dt.01-06-2026 2/3 dispute is pending between the parties. Counsel further submits that from the contents of FIR, it become crystal clear that the place of occurrence is a maize field where open fire took place between both the parties and for the same place and date of occurrence, there is case and counter case being Amarpur P.S. Case no- 726 of 2026 and Amarpur P.S. Case no- 28 of 2026 filed by the informant and the petitioner both. Counsel further submits that antecedent of the petitioner is not clean rather in 2024 also the same type of dispute has taken place in which the petitioner is on bail. Counsel further submits that petitioner is ready to fulfill all the conditions whatsoever shall be imposed in the event of granting bail.
6. Learned APP for the State opposes the prayer for bail and fairly submits that from the address made in the both FIRs, it transpires that they are gotiya and for the same date and place of occurrence, case and counter case has been lodged.
7. In the facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the Trial Court within a period of four weeks from today, on furnishing bail bond of ₹30000/- (thirty thousand) as mentioned in Section 2(1) (d) of the Bharatiya Nagrik Suraksha Sanhita, 2023 to the satisfaction of the Learned C.J.M. Banka,
