Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) and 37(2)(c)(d) of Bihar Prohibition and Excise Act, 2016.

Recovery of liquor was made from the house of the petitioner when no family member was there. Petitioner is in custody since 02.06.2020. Petitioner has got criminal antecedent of identical nature.

Learned counsel for the petitioner submits that in earlier criminal cases, the petitioner was implicated on suspicion only when there was no direct material. Investigation of the case is already complete and petitioner is ready to cooperate with the trial.

Considering the facts aforesaid, let the petitioner,

Patna High Court CR. MISC. No.33845 of 2020(3) dt.08-01-2021 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Buniyadganj Police Station Case No.182 of 2017 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
