The petitioner seeks bail in Shahkund (Sajour) P.S. Case no. 126/2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code. The widow of the deceased alleged that on 30.07.2014 the petitioner assaulted her husband for not inviting him on the occasion of marriage of his son. A Panchayati was also held and it is alleged that the panchas brutally assaulted her husband. Consequently, her husband Prakash Thakur was admitted to hospital and died on 31.07.2014. No specific allegation of assault is made against the petitioner. Similarly situated co-accused Rajesh Thakur and others have already been enlarged on bail. The case was lodged only after the death of Prakash Thakur on 31.07.2014.

Patna High Court Cr.Misc. No.40511 of 2015 (2) dt.02-09-2015 2/2 Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Bhagalpur, in connection with Shahkund (Sajour) P.S. Case No. 126/2014.
