The petitioner is languishing in jail since 01.04.2015 in a case instituted under Sections 392 and 411 of the Indian Penal Code.
As alleged, while the informant along with his friend was on his way to see Chaiti Puja, four miscreants armed with knife stopped the vehicle asked him to leave the motorcycle and also snatched some cash and also assaulted them with slaps and fists.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. He is in custody since 01.04.2015. Chargesheet has been submitted in the case.
Patna High Court Cr.Misc. No.37525 of 2015 (3) dt.06-10-2015 There is no allegation of tampering of evidence against the petitioner. Petitioner is not named in the FIR. The only material against the petitioner is that his name appeared on the basis of the confessional statement of co-accused. The same co-accused has been granted bail vide B.P.No. 551 of 2015 by the court below itself.
On behalf of the State, it has been submitted that the petitioner has been named in course of investigation. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Samastipur in connection with N.H. Bangra P.S.Case No.17 of 2015, G.R.No.715 of 2015.
