Petitioner seeks bail in Ismailpur P.S. Case No.06 of 2019 instituted for the offence under Section(s) 302/34 Indian Penal Code and Section 27 of the Arms Act pending in the Court of the Chief Judicial Magistrate, Naugachia.

In the written report, there is specific allegation against this petitioner of causing firearm injury to husband of the informant on right side below the chest on account of which he became unconscious and subsequently died.

The Sessions Judge has mentioned in the impugned order that witnesses in the case diary have supported case of the prosecution. Doctor has opined cause of death due to gun shot injury.

Patna High Court CR. MISC. No.38793 of 2019(3) dt.30-07-2019 2/2 Keeping in view direct allegation against the petitioner, this Court is not inclined to enlarge him on bail. Prayer of the petitioner for grant of bail is rejected at this stage.

Petitioner is in custody since 05.02.2019.

The trial Court is directed to expedite the trial and make all efforts to conclude the same as early as possible, preferably, within a period of nine months from the date of receipt of a copy of this order.

Liberty is given to the petitioner to renew his prayer for bail after nine months, if no substantive progress is made in the trial.
