1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420 and 34 of the Indian Penal Code.

3. Learned counsel appearing on behalf of the petitioner submits that notices were issued on O.P. No. 2 by order dated 18.06.2025 and from perusal of the office report dated 29.07.2025, it would manifest that notice was received by the O.P. No. 2 personally, but then O.P. No. 2 chooses not to appear and contest.

4. In view of the submission made by the learned

Patna High Court CR. MISC. No.35789 of 2025(4) dt.20-08-2025 2/3 counsel appearing on behalf of the petitioner, the notice is deemed to be validly served.

The learned counsel for the petitioner submits that petitioner has antecedent of five cases and the informant alleges that on assurance of the petitioner, he had given an amount of Rs. 34,51,000/- to Om Prakash Arya and Ashok Kumar Purvey on different dates for purchasing a piece of land, but the sale deed was not executed and later the informant came to know that the land for which the money was taken, is government land.

Learned counsel for the petitioner submits that the only allegation against this petitioner is that it was at his behest that the informant paid the aforesaid amount to Om Prakash Arya and Ashok Kumar Purvey. It is submitted that the informant has received his money from Om Prakash Arya and Ashok Kumar Purvey and the matter has been compromised, as such, the informant did not appear to contest.

7. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

8. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court

Patna High Court CR. MISC. No.35789 of 2025(4) dt.20-08-2025 3/3 within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Ashok Paper Mill (APM) P.S. Case No. 195 of 2023 subject to the conditions as laid down under Section 482 (2) of BNSS.

9. Accordingly, the instant anticipatory bail application is allowed.
